How Does an Apostille Work?
The Hague Convention of 1961 established the requirement for apostille certification. It made important documents legal and recognizable in foreign countries and standardized a process for doing so. Legal documents issued in one nation can be made legal in another country that also signed the convention.
An apostille certificate authorizes the party that has signed the document and verifies the authenticity of the seal on the document. Obtaining an apostille can take time, but knowing the right process can streamline the process, whether you need to certify a birth certificate, court document, power of attorney, corporate document, will, passport, driver’s license, or another document.
What are the requirements for apostilling a document in New York?
Original Document
You will need to make sure of the following:
- You have an original document or duplicate issued by the state.
- The appropriate signature is provided.
- The original document was recently issued.
The New York Secretary of State apostilles public and private documents if the following applies:
For the five boroughs of Manhattan, Queens, Bronx, Brooklyn, and Staten Island:
- Birth and death records bear the signature of Steven P. Schwartz, city registrar.
- Birth and death records provide a letter of exemplification.
- Marriage certificates were issued from the marriage bureau and are certified copies with the original signature and stamp of the city clerk on the back of the document.
For New York State:
- All birth, death, marriage, and divorce records were issued from New York. Department of Health, local registrar, or town clerk in the city, town, or village where the event took place.
- Documents with the signature of Peter M. Carucci, Director of Vital Records, are valid for an apostille.

- Notarized documents must contain a “Jurat” to be acceptable for an apostille.

Scanned copy of Original
We are able to work on a scanned copy of your original if the original is not available due to any of the following reasons:
- Appropriate signature is NOT provided.
- Original document is damaged.
- Original document was issued over 10 years ago.
For this option please make sure the destination country ACCEPTS apostilles of the scanned photocopy instead of the original document; most countries do accept an apostille of the scanned photocopy.
How Do I Prepare My Document for an Apostille?
If you have vital records documents; such as; birth certificates, marriage certificates or death certificates, please make sure your document is original and that it has the proper signatures and seals. If your document is a Power of Attorney, Affidavit, letter of authorization to travel or any instrument that needs to be signed by you or your family, please have the document notarized near you and then mail it, or if you live near our offices we can notarize the document for you at no extra charge. Once you verify you have the appropriate signatures or it has been properly notarized we are able to present your document at the corresponding clerk of a county court. Then we will present it to the secretary of state to finalize the process.
